Terms of Use

These Terms of Use (“Terms”) form an agreement between you and Mochiverse Inc. (“Mochiverse,” “we,” “us” or “our”). They apply to the Mochiverse website at mochiverse.ai, our mobile applications, and related features and tools that link to these Terms (together, the “Services”). By creating an account or using the Services, you agree to these Terms. If you do not agree, you must stop using the Services. Our Privacy Policy explains how we handle personal information.

You must be at least 18 years old to use Mochiverse. You can contact Mochiverse Inc. at hello@mochiverse.ai.

1. Our services

Mochiverse provides interactive fictional stories featuring AI characters, animated scenes, generated dialogue, images and related entertainment features. Available features may differ by platform, region or release. You may use the Services only where doing so is lawful. Additional terms shown for a particular feature or purchase apply to that feature and take priority if they conflict with these Terms on that specific subject.

2. Eligibility and your account

You must be 18 or older, meet any higher age of legal majority where you live, and have capacity to enter this agreement. Minors may not use the Services with parental permission. You must provide accurate account information, keep it current and protect access to your Apple, Google or other supported sign-in account. Maintain one personal account, do not share or sell access, and tell us promptly if you suspect unauthorized use. You are responsible for activity you authorize through your account, including through a connected client.

3. AI characters and generated content

AI characters are fictional. Their messages, apparent emotions, memories and actions are generated entertainment, not communications from a real person. Generated statements do not necessarily reflect the views of Mochiverse or its team. Output can be inaccurate, inconsistent, repetitive, offensive or unsuitable, and other users may receive similar output. We do not guarantee that generated material is unique or eligible for copyright protection.

Do not rely on characters or generated material for medical, mental-health, legal, financial or other professional advice or important real-world decisions. The Services are not a crisis or emergency service. If you or someone else is in immediate danger, contact local emergency services or an appropriate crisis service. You are responsible for evaluating output before using or sharing it.

4. Our intellectual property and your license

The Services, including our software, interface, character designs, scene assets, artwork, audio, logos and branding, are owned by Mochiverse or its licensors and are protected by applicable intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, personal, non-transferable and revocable license to access and use the Services for non-commercial entertainment, including downloading the app onto devices you own or control. This license ends when your access ends under these Terms.

Except as permitted by law or a separate license we provide, you may not reproduce, distribute, sell, sublicense or commercially exploit the Services or our assets, or use our branding to suggest an endorsement. Open-source components remain subject to their own licenses. These Terms do not transfer ownership of your original submissions to us or override any express usage rights included with an available export feature.

5. Your content and permissions

You retain any ownership rights you have in the messages, prompts, images, descriptions and other material you submit (“Your Content”). You confirm that you have the rights and permissions needed to submit it and that our processing of it as described here will not violate another person’s rights or applicable law.

You grant Mochiverse a worldwide, non-exclusive, royalty-free license to host, store, copy, process, adapt and display Your Content as necessary to provide the features you request, maintain and improve the Services, and investigate safety or support issues. This includes sending relevant inputs to service providers for AI generation and processing. If you choose to publish or share content, the license also permits the distribution needed for that feature. It does not give us unrestricted permission to sell private conversations or use them in advertising.

The license lasts while needed for those purposes and ends when Your Content is deleted from our systems, except for lawful retention and copies described in the Privacy Policy. Personal information remains subject to that policy, including its statements about model training. We may use voluntary product feedback to improve the Services without compensation to you; this does not transfer ownership of your private stories.

6. Prohibited activities and content

You must not use the Services to:

• Break the law, infringe intellectual-property rights, invade privacy or facilitate fraud or other unlawful conduct.
• Create, request, upload or distribute sexual content involving anyone under 18, including fictional characters depicted or presented as minors, or otherwise exploit or endanger children.
• Create non-consensual intimate imagery, sexual impersonations of real people, or material that facilitates sexual exploitation or trafficking.
• Threaten, harass, stalk, dox or impersonate others, or promote violence, terrorism, hateful abuse or real-world harm.
• Upload profile photos or publicly shared material that is sexually explicit, hateful or graphically violent, or upload material you lack permission to use.
• Encourage self-harm or provide instructions for causing serious harm to yourself or others.
• Bypass age, safety, authentication, rate, gem or payment controls; exploit a bug; or obtain another person’s account or private data.
• Introduce malware, overload systems, send spam, manipulate rewards or purchases, or interfere with others’ use.
• Scrape or collect content in bulk, reverse engineer the Services, or resell access, except where applicable law or our express authorization permits it.
• Use unauthorized bots, scripts or other automation. Officially supported tools and connections may be used within their documented permissions and limits.

Fictional framing or a character’s response does not authorize prohibited conduct or override these rules.

7. Reports and service management

Use an available in-app report control or email hello@mochiverse.ai to report unsafe content, abuse or a rights violation. Reporting a scene includes recent conversation excerpts for review, as explained in the Privacy Policy. We may investigate reports, remove or restrict content, refuse requests, limit features or suspend accounts where reasonably necessary to enforce these Terms, comply with law or protect the Services and others. We do not promise to review every message or prevent every prohibited response. You can contact us to ask for review of an enforcement decision; any additional rights under applicable law remain available.

8. Gems and virtual items

Gems are virtual credits used for features such as story turns. They are licensed for use within Mochiverse, have no cash redemption value, and cannot be transferred, sold, exchanged for money or used outside the Services. Reward availability, eligibility and feature costs may change. The cost shown for a feature applies when you choose to use it. We may correct balances resulting from errors, fraud or abuse.

Account deletion or lawful termination ends access to unused gems, subject to any refund or other rights required by law. Changes to paid credits or discontinuation of a paid feature remain subject to applicable notice, refund and consumer-protection requirements. Promotional credits may have additional conditions disclosed with the offer.

9. Purchases and refunds

If we offer paid gems or other paid features, the price, currency, applicable taxes and material purchase conditions will be shown before confirmation. You authorize the applicable checkout provider to process purchases you confirm. App-store purchases are also subject to that store’s payment and refund rules. We do not collect your full payment-card details through the story interface.

Except where applicable law, the purchase terms or the relevant store’s policy provides otherwise, purchases of delivered digital items are final. Request an app-store refund through the store that processed the purchase; contact hello@mochiverse.ai for help with delivery or account-credit issues. Nothing in these Terms removes a mandatory refund, withdrawal or other consumer right.

10. Subscriptions, if offered

This section applies only if you choose a subscription we offer. The purchase screen will disclose its price, billing interval, renewal terms, any trial and how to cancel. A subscription renews automatically only as disclosed and authorized at checkout, unless you cancel before the next renewal under the applicable provider’s rules. Manage app-store subscriptions through the store’s subscription settings and other subscriptions through the controls identified at purchase. Deleting the app or your Mochiverse account does not by itself cancel billing through a third-party store. Price changes and refunds are subject to the purchase terms and applicable law.

11. Third-party services

The Services rely on external providers, including sign-in, AI, hosting and app-store services, and may link to third-party content or allow authorized connections. Your direct use of another service is subject to its terms and privacy policy. You are responsible for choosing the tools you connect and the access you authorize. We do not control external sites, endorse every linked item or guarantee third-party availability. This section does not limit any responsibility we have under applicable law for providers acting on our behalf.

12. Mobile application terms

You must comply with the applicable app-store usage rules and third-party agreements, including your mobile carrier’s terms. You are responsible for device and connectivity costs. You may not transfer or sublicense the app except as an applicable store rule or law permits.

For Apple App Store downloads, the agreement is with Mochiverse Inc.. Use is permitted on Apple devices you own or control under Apple’s usage rules, including permitted Family Sharing or volume purchasing. We are responsible for the app, content, support, applicable warranties, product and regulatory claims, and investigation and resolution of intellectual-property claims. Apple owes no maintenance or support. For a warranty failure, you may notify Apple for a refund of the app’s purchase price; where lawful, Apple has no other warranty obligation and remaining claims are our responsibility.

You represent that you are not in a country under U.S. embargo or designated as supporting terrorism, or on a U.S. restricted-party list. Apple and its subsidiaries may enforce these app terms as third-party beneficiaries.

13. Privacy

Our Privacy Policy describes how accounts, conversations, uploads and technical information are processed, including information sent to external AI providers. Please review it before submitting personal information. An AI character cannot enter a separate privacy or confidentiality agreement with you.

14. Copyright complaints

We respect intellectual-property rights. If you believe content in the Services infringes your copyright, emailhello@mochiverse.ai with your contact details, identification of the copyrighted work, the location of the allegedly infringing material, an explanation of your rights, and a statement that your report is accurate and made in good faith. We may request additional information, remove or restrict disputed material, and suspend repeat infringers where appropriate. Do not submit knowingly false claims.

15. Suspension and termination

You may stop using the Services at any time and delete your account in Settings → Delete account or by contacting us. We may suspend or terminate access for material or repeated violations, legal requirements, fraud, or a material risk to users or the Services. Where reasonably possible and required by law, we will provide notice and an opportunity to resolve the issue. Immediate action may be necessary for safety, security or legal reasons. You may ask us to review a decision by emailing hello@mochiverse.ai.

When access ends, the service license ends and you may lose access to stories, saved progress and virtual items. Data handling remains subject to the Privacy Policy. Payment obligations already incurred and provisions that logically continue, including intellectual-property protections, liability limits and dispute provisions, survive to the extent applicable. Mandatory consumer rights remain unaffected.

16. Changes and interruptions

We may update, replace or discontinue features, models, characters or parts of the Services. Maintenance, third-party outages or other events may interrupt access, and we cannot guarantee preservation of every scene or generated response. For material changes affecting a paid service, we will provide any notice, remedy or refund required by law or the applicable purchase terms.

17. Disclaimers

TO THE EXTENT PERMITTED BY LAW, THE SERVICES AND GENERATED CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE ACCESS, OR THE ACCURACY, SAFETY, SUITABILITY OR UNIQUENESS OF AI OUTPUT. THESE DISCLAIMERS DO NOT EXCLUDE WARRANTIES OR RIGHTS THAT APPLICABLE LAW DOES NOT ALLOW US TO EXCLUDE.

18. Limitations of liability

TO THE EXTENT PERMITTED BY LAW, MOCHIVERSE AND ITS OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA OR GOODWILL ARISING FROM THE SERVICES. OUR TOTAL LIABILITY FOR CLAIMS ARISING FROM OR RELATED TO THE SERVICES WILL NOT EXCEED THE GREATER OF US $50 OR THE AMOUNT YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

These limits apply only where lawful. They do not limit liability for fraud, willful misconduct, death or personal injury caused by negligence, or other liability that cannot legally be excluded or limited. Your mandatory statutory and consumer rights remain available.

19. Indemnification

To the extent permitted by applicable law, you agree to defend and indemnify Mochiverse and its officers, employees and agents against third-party claims, damages and reasonable costs, including legal fees, arising from Your Content infringing another person’s rights or your unlawful use or material breach of these Terms. This does not apply to the extent a claim results from our own breach, negligence or unlawful conduct. We will notify you of a covered claim, provide reasonable cooperation, and not agree to a settlement that imposes an admission or non-monetary obligation on you without your consent.

20. Governing law and disputes

California law governs these Terms without regard to conflict-of-law rules, except that mandatory protections in the place where you live continue to apply. Subject to those protections, disputes may be brought in the state or federal courts in California with jurisdiction over the dispute. If applicable law gives you the right to bring a claim in your local courts, these Terms do not remove that right. You may contact hello@mochiverse.ai to seek an informal resolution, but doing so is not a condition of exercising legal rights or seeking urgent relief.

21. General terms and electronic communications

These Terms and any applicable feature-specific terms form the agreement concerning your use of the Services. If a provision is unenforceable, the remaining provisions continue to apply to the extent possible. A failure to enforce a provision is not a waiver. You may not transfer this agreement without our consent; we may transfer it as part of a lawful business reorganization or transfer, subject to your applicable rights. No third party has enforcement rights except where expressly stated, including Apple’s rights above.

We may communicate with you electronically through the Services or your account email, including notices about security, purchases and changes to these Terms. You agree to receive these service communications electronically to the extent permitted by law. Any marketing choices remain separate. Keep your contact information current and retain a copy of these Terms for your records.

22. Changes to these terms

We may revise these Terms and will update the date above. We will provide reasonable advance notice of material changes through an appropriate channel, except when an immediate change is needed for legal or security reasons. Changes apply prospectively from the stated effective date. Continuing to use the Services after that date means you accept the revised Terms, subject to any additional consent required by law. If you disagree, stop using the Services and cancel any subscription through the relevant billing provider.
